These general conditions of sale are governed by the Consumer Code (Legislative Decree no. 206/2005) and the rules of the Civil Code.
The products and related prices presented on the sites constitute offers to professional users and/or end users, defined by law as "Consumers". Purchase and/or rental contracts entered into on the sites are concluded with MILK.
Offers of Products as well as their prices are valid while still visible on the Sites and while stocks last.
"Consumer" means, within the meaning of Article 18 of the Consumer Code, a natural person acting for purposes outside the scope of his or her trade, business, craft or profession. We ask you the courtesy of refraining from purchasing products from MILK if you do not fall into the stipulated categories.
MILK reserves the right not to process orders received from users who are not "Consumers" as well as any other orders that do not adhere to MILK's commercial policy .
These general terms and conditions of sale exclusively govern the offer, transmission and acceptance of purchase orders regarding products on the sites between users and the MILK company itself addressed to persons who have reached the age of majority (18 years old).
The general terms and conditions of sale do not regulate the provision of services or sale of products carried out by third parties using direct links to the sites through banners or through other hyperlinks/links. Before placing orders and purchasing products and services from these third parties, we suggest that you check the general terms and conditions of sale and use of these third parties, as MILK under no circumstances can be held responsible for the provision of services promised by third parties or the execution of e-commerce transactions between users of MILK-owned sites and third parties.
An order is binding and irrevocable from the time it is received by MILK.
To submit an order to purchase one or more products on the Websites, you must complete all pages in the shopping cart and electronically transmit the page with all personal and purchase data to MILK, following the instructions you will find after adding a product/service to your shopping cart and registering to purchase.
The check-out page contains a link to these general terms and conditions of sale and also contains information on the main characteristics of each product ordered and its price (all applicable taxes included), the type of payment you have chosen to use, the conditions for the delivery of the products, the contributions required for delivery and transportation as well as references to the general terms and conditions for returning products purchased online.
An order will be deemed submitted when MILK receives your order proposal electronically and the order information has been preliminarily verified as correct.
Before submitting your order proposal to MILK for the purchase of selected products online, you will be asked to carefully read the general terms and conditions governing the sale and purchase.
The order proposal will be stored in our databases for the time required to process your order, in accordance with current regulations. You will be able to access your order by clicking on the section called.
"MY ACCOUNT" or by contacting Customer Service.
In addition, a copy of the computer evidence relating to the conclusion of the contract will be kept for the time required by applicable civil and tax regulations.
Before proceeding with the submission of your order, you will be asked to identify and correct any possible errors that may have occurred while filling in the fields.
After your order has been registered by MILK, it will be processed as quickly as possible.
MILK may not take over and process your order if there is insufficient assurance of payment solvency, if orders are incomplete or incorrect, or if products are no longer available.
In the above cases, we will inform you by e-mail that the contract has not been executed and that MILK has not confirmed your purchase order specifying the reasons.
Other than the information provided, MILK is not able to give more precise indications regarding the availability of products; therefore, once we have reviewed your order, we will notify you by e-mail if some of the products you ordered are not available.
Without prejudice to the provisions of the General Conditions, it is understood that this order is for divisible sales services, distinct and for several economic units, as many as the products ordered, as expressly agreed between Customer and MILK with the submission of the order itself and its acceptance;
therefore, in the event MILK's performance of the order is limited to some of the products ordered due to unavailability of some or for other justified reason independent of MILK's will, by placing the order theBuyer declares his interest in and consents to the partial performance of the order with respect to the other products, which then may not be refused by the Buyer, nor may it empower the Buyer to revoke the order.
In the event that MILK is unable to accept the order received from the Customer in full, giving course to partial acceptance of the order with regard to the products available, any exercise of the right of reconsideration provided for in Article 8 of these General Conditions will take place without any charge for transportation costs to the Customer.
You are aware that by submitting your order to MILK you accept without reservation all the provisions contained in the general terms and conditions of this contract with MILK and that you undertake to comply with them. If you do not agree with any of the provisions contained in these general terms and conditions of sale, we ask you the courtesy not to send your 'order for the purchase of products on the sites owned by Milk.
By submitting your order to MILK you consent to and accept these general terms and conditions of sale as well as additional terms and conditions contained on the sites also through links, including the general terms and conditions of use, Privacy Policy and terms of withdrawal.
When an online order is confirmed, MILK will transmit to the buyer by e-mail, the contents of which must be stored on a durable medium, a copy of the receipt of the purchase order, containing a summary with information about theorder (general terms and conditions of sale, the main characteristics of the products purchased, detailed information on the price, payment terms, existence of the right of withdrawal, time and manner of returning the products, contribution for transportation required of the customer geographical address where to submit any complaints and information on existing commercial guarantees and support services).
By submitting your order to MILK you agree to receive the invoice/receipt issued for tax purposes in electronic format. You may receive a paper invoice by making an express request to our Customer Service Department.
On the sites we offer for sale products purchased by MILK directly from carefully selected manufacturers, distributors and suppliers for their strict and stringent quality controls.
Products for sale on the sites are of quality never below the standard of the target market.
The main features of the products are indicated on the sites on the product web page.
Images may be for illustrative purposes only. Products offered for sale on the sites may not exactly correspond to the real thing in terms of image and colors, which may be varied by the browser or monitor type used.
The technical characteristics of a product, the approvals and safety statements of a product sold through the sites are indicated on the label or packaging or in the instructions for use of the product itself and may be given in full or in excerpts on the Site itself to accompany the illustration of the Product.
All products sold on the sites meet the standards and are approved in accordance with European Community standards. We are not liable for any deviation from the standards of countries outside the European Community and/or lack of product approval in those countries.
The price of the products is expressed in euros and includes VAT, as well as all applicable taxes and fees, and transportation costs. Prices are subject to change. Check the final sale price before sending the order proposal.
Orders placed from a site in a different country than the country of delivery of the goods, or to addresses to which MILK cannot deliver (e.g. P.O. BOX. or territories/areas/areas excluded from the EU customs territory), will be automatically cancelled.
All products are delivered with an attached identification label/tag or sealed. Do not remove the seals of the purchased products or the label/tag if you wish to return the purchased product.
We are in no way responsible for incorrect information or data and any technical or other inaccuracies provided by third parties that may be contained in the products.
Should you decide to exercise your right to return products purchased from Milk, please note that MILK has the right not to accept returned products that have been altered from their original condition or have been damaged (e.g., without a warranty tag or seal)
Delivery terms resulting from the contract of sale or rental are approximate and shall apply under normal working and supply conditions, and under no circumstances shall any delays entitle the customer to any refund.
The Customer or his designee shall be present at the place of unloading of the goods specified in the contract to receive the goods and shall sign the travel documents.
The return of the material shall always be understood to be ex our Head Office in Rome.
Shipment operated by courier contracted with MILK is always insured at the customer's expense. In the event of theft and damage during transport MILK shall not be held liable under any circumstances if the shipment had not been insured at the express request of the customer.
In the event of lack of or non-conformity of the goods any complaints must be made within 24 hours of delivery, in which case MILK will replace the goods as soon as possible, the obligation of the customer to make payments on the agreed due dates remaining firm and unbreakable.
In this case, the customer waives any and all claims for damages. Transport costs are always borne by the Customer, who has the option of entrusting the transport to its own trusted courier or of relying on a courier contracted with MILK, which will charge the cost on the invoice. No equipment may be returned except with MILK's authorization, and if this is the case, only Free Port and properly packed packages will be accepted. Said goods must also include manuals and miscellaneous parts. Any shortages or damages will be charged.

Amounts are always exclusive of VAT and ex our office in Rome. Freight, courier and any insurance costs are always borne by the customer whether they are made by carrier contracted with MILK or by shipper chosen by the customer.

Payments must be made on the agreed due date avoiding any deduction even by way of rounding only. Any delay in payment will give rise to the cancellation of any agreed discounts as well as the application of late payment interest pursuant to Legislative Decree No. 231/2002.
In the installment sale, the goods remain, in accordance with Article 1523 of the Civil Code, the property of MILK until they are paid in full. The buyer, however, assumes the risks from the time of delivery.
Payment of the prices of the products purchased on the sites and the related transportation fees must be made using one of the procedures indicated when purchasing online.
In the case of payment by credit card, all related details(e.g. card number or expiration date) will be captured and managed directly on Paypal's site, as the provider for electronic payment services, without third parties having access to it. Such details will never be acquired and used directly by MILK. The site will perform all payment processing always through the same payment provider: so either your purchase or refund, in accordance with the exercise of your right of withdrawal, or for cases reported as possible fraud by the public security authority.
If, for whatever reason, it is not possible to charge the amount due, the sale process will be automatically cancelled and the sale will be terminated. You will be informed by appropriate automatic e-mail communication.
Web discount coupons are personal electronic codes that allow you to take advantage of a discount on your purchase on the sites.
The box where you enter your discount code is displayed on the first page of the shopping cart: after you have placed your items in the cart and set your electronic code, press the confirm button to view your new purchase total.
Limitations on the use of web vouchers:
The voucher, unless otherwise agreed, may be used only once, with the exception of returns (as specified in Section 7.4); the voucher may never be exchanged for money; you may not use more than one voucher per order unless stated otherwise in the voucher; the voucher may apply only to items with a value greater than the voucher itself;
the voucher may not be used for certain sale items as unique samples or for sale for charitable purposes;
the web voucher may not be used in any way for the purchase of other products, except where specifically permitted.
If for some reason you are not satisfied with your order placed on the site, you may return the item to which you applied the web voucher by following the standard return procedure as described in theReturns section. Once your return is accepted, the respective voucher code will be restored to its original value. The difference in price between the value voucher and the item you purchased will be fully refunded, following the standard refund procedure.
The general terms and conditions of sale may be updated to make them conform to new laws and regulations or for other reasons. The new general terms and conditions will be effective from the date of publication on our website.
This contract is governed by Italian law.
In the case of a consumer user, the Court of residence or domicile of the consumer, if located in Italy, will have jurisdiction.
For any other dispute will be competent, instead, the Court of Rome.
